Service Level Agreement (Terms & Conditions) – Next Horizon

  • Welcome to Next Horizon. To ensure the highest quality of service and to protect the rights of both parties, please review the following terms and conditions carefully before proceeding with your order.

1. Ordering & Execution Policy

  • Creative Brief: The client must provide a clear "Creative Brief" including the editing style, preferred music, and any references before the commencement of work. Source Material Quality: Next Horizon is not responsible for the poor quality of the original footage provided by the client. However, we will exert our best technical efforts to enhance it wherever possible. Timeline: The agreed-upon delivery period starts only after all required materials (Raw Footage) have been received in full. Any delay in submitting materials by the client will not be counted as part of the execution period.

2. Revision Polic

  • **Number of Revisions:** The number of free revision rounds varies depending on the selected package and service. Please refer to the package details at the time of ordering for the specific number included. **Additional Fees:** Any major changes that deviate from the original agreed-upon scope (e.g., changing the core concept after editing has begun) will incur additional fees to be agreed upon in advance. **Revision Window:** Revision requests must be submitted within **48 hours** of receiving the draft. After this period, the project will be automatically considered approved and completed. **Project Completion Deadline:** If the revision and communication process exceeds **14 days** from the date of the first draft delivery without the project being closed, Next Horizon reserves the right to close the file and consider it completed.

Payment & Financial Terms

  • ### A. General Services (Available to All Users) Payment is made in full upfront via **PayPal** upon selecting a package and adding it to the cart. **Refund Policy:** - Cancellation **before work begins** → **85%** of the total amount paid will be refunded - Cancellation **after work has begun** (execution, review, or revision stage) → only **25%** of the total amount paid will be refunded > The official start of work is determined by a notification sent to the client via the platform or official communication channels. --- ### B. Event Photography Service (Available to Algerian Users Only) Payment is made in two stages via **cash payment or Bariidi Mob** exclusively: - **Deposit:** 40% of the total service value, paid upon booking confirmation - **Remaining Balance:** 60% paid upon full completion of the service **Refund Policy:** - Cancellation **before work begins** → **25%** of the total amount paid will be refunded - Cancellation **after work has begun** → the deposit is **non-refundable** under any circumstances

4. Intellectual Property & Rights

  • **Ownership:** Ownership of the final edited video is transferred to the client only after full payment has been settled. **Portfolio Rights:** Next Horizon reserves the right to display **portions** of completed works in its portfolio or on its social media platforms for promotional purposes without prior consent. However, publishing the **complete project** requires the client's explicit written approval via official communication channels. **Copyright Compliance:** We are committed to using licensed or royalty-free music and assets to ensure your content is fully protected from any copyright claims.

5. Communication & Workflow

  • **Official Channels:** All communication is conducted exclusively through the following channels: - **Next Horizon Platform** — via the internal messaging system on the website - **WhatsApp Business** — for direct and quick communication - **Email** — for official correspondence and documentation All agreements and modifications are documented through these channels only. Any agreement made outside of them will not be considered valid. **Working Days & Hours:** - **Working Days:** Saturday through Thursday - **Response Hours:** 9:00 AM to 9:00 PM Any message received outside these hours will be addressed on the next working day during official working hours.

6. Privacy & Data Protection

  • Next Horizon is committed to protecting clients' personal data and will not share it with any third party without explicit consent, except where required by law. All submitted data is used exclusively for the purpose of delivering the service and communicating with the client.

7. Dispute Resolution

  • In the event of any dispute between the client and Next Horizon, the following procedure applies: **Step 1:** Direct communication through official channels to attempt an amicable resolution within **5 business days.** **Step 2:** If no resolution is reached, either party reserves the right to escalate the matter to the relevant authorities in accordance with applicable laws. All agreements documented through official channels shall serve as the primary reference in any dispute.

8. Account & Registration Policy

  • **Account Creation:** To access Next Horizon's services, the client must create an account with accurate and up-to-date personal information. Any account created with false or misleading information may be suspended or permanently deleted without prior notice. **Account Responsibility:** The client is solely responsible for maintaining the confidentiality of their login credentials. Next Horizon shall not be held liable for any unauthorized access resulting from the client's failure to secure their account. **Account Suspension:** Next Horizon reserves the right to suspend or terminate any account that violates these terms and conditions, engages in fraudulent activity, or behaves in a manner deemed harmful to the platform or its users.

9. Service Availability

  • Next Horizon strives to maintain continuous platform availability. However, we do not guarantee uninterrupted access at all times. The platform may be temporarily unavailable due to scheduled maintenance, technical issues, or circumstances beyond our control. In the event of a service interruption affecting an active project, Next Horizon will communicate with the client through official channels and adjust the delivery timeline accordingly at no additional cost.

10. Force Majeure

  • Next Horizon shall not be held liable for any delay or failure to deliver services resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, internet outages, civil unrest, or any other unforeseeable events. In such cases, the client will be notified promptly through official channels, and the project timeline will be extended accordingly. If the situation persists for more than **30 days**, either party reserves the right to cancel the project, with a fair refund determined based on the work completed to date.

11. Limitation of Liability

  • Next Horizon's total liability to the client under any circumstance shall not exceed the total amount paid by the client for the specific service in question. Next Horizon shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of revenue, loss of data, or reputational damage arising from the use of our services.

12. Amendments to Terms

  • Next Horizon reserves the right to update or modify these Terms and Conditions at any time. Clients will be notified of any significant changes via the platform or official communication channels at least **7 days** before the changes take effect. Continued use of the platform following the notification period constitutes acceptance of the updated terms. It is the client's responsibility to review the terms periodically.

13. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of **the People's Democratic Republic of Algeria**. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the competent Algerian courts.
